1. Acceptance of Terms

By accessing or using RevParts ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Platform. These Terms apply to all users, including buyers and sellers.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use RevParts. By using the Platform, you represent that you meet these requirements. Sellers must additionally provide accurate business and identity information during registration.

3. Seller Accounts

To list parts for sale, you must complete the seller onboarding process, including identity verification and business information. You agree that:

All information submitted is accurate, truthful, and current.
You will maintain the accuracy of your account information.
Misrepresentation may result in account suspension and legal action.
You are responsible for all activity under your account.
You will comply with all applicable local, state, and federal laws regarding the sale of used parts.

4. Listings and Part Accuracy

Sellers are solely responsible for the accuracy of their listings, including part condition, photos, fitment data, and pricing. RevParts does not inspect or verify individual parts. Sellers must:

Accurately describe the condition of every part.
Only list parts they legally own and have the right to sell.
Not list stolen, counterfeit, recalled, or hazardous parts.
Honor the price and condition described in the listing at the time of purchase.

5. Buyer Protections and Escrow

RevParts uses an escrow system where buyer payments are held until delivery is confirmed. Funds are released to sellers after the buyer confirms receipt and condition match, or automatically 72 hours after delivery if no dispute is filed. Buyers acknowledge that:

All sales are final unless the part materially differs from the listing.
Disputes must be filed within 72 hours of delivery confirmation.
RevParts reserves the right to mediate and resolve disputes at its sole discretion.

6. Fees and Payments

Seller subscriptions are billed on a monthly basis per your selected plan (Starter, Pro, or Elite). Transaction fees, if applicable, are disclosed at the time of listing. RevParts uses Stripe for payment processing. All fees are non-refundable unless otherwise stated.

7. Prohibited Conduct

You agree not to:

Use the Platform for any unlawful purpose.
Post false, misleading, or fraudulent listings.
Circumvent the escrow or payment systems.
Harass, threaten, or harm other users.
Attempt to access accounts or data that are not yours.
Use automated tools to scrape or interfere with the Platform.

8. Intellectual Property

All Platform content, branding, logos, and software are the property of RevParts or its licensors. You may not reproduce, distribute, or create derivative works without explicit written permission. By uploading photos or content, you grant RevParts a non-exclusive license to display that content on the Platform.

9. Disclaimers and Limitation of Liability

RevParts is a marketplace platform and is not a party to transactions between buyers and sellers. The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, RevParts shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.

10. Termination

RevParts reserves the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately.

11. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Colorado.

12. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will notify users of material changes via email or in-platform notice.
